Mr. Dailey is a Certified Family Law Specialist focusing on appellate issues.  He is a Fellow in the American and International Academies of Matrimonial Lawyers.  He is the publisher and author of ATTORNEY’ S BRIEFCASE®LEGAL RESEARCH SOFTWARE and the author of SupportTax® and Lawgic®.  The many awards he has received include a Lifetime Achievement Award by the State Bar of California Family Law Section; the 30th Anniversary Outstanding Service Award from Association of Certified Family Law Specialists as well as the 1995 Hall of Fame Award; and the 2005 Outstanding Conference Speaker Award from the Cal. CPA Education Foundation.  Some of his more recent appellate cases include Marriage of Valli; Elkins v. Superior Court; Marriage of La Musga; Marriage of Macilwaine, Marriage of Facter; Marriage of Hibbard; Marriage of Hill & Dittmer; Marriage of Cadwell-Faso; Marriage of Sorge; and Marriage of Alter.

The Funky Credit Day Program is held each year for members of the State Bar of California who are actively practicing law. Attorneys are required to complete a total of 25 hours of approved credit every three years, which include credits on legal ethics as well as competence issues, such as substance abuse and mental health, and elimination of bias, which includes implicit bias.

Although everyone is welcome to attend this program, we would like to remind you that the MCLE Group 2 (H-M) has a deadline of 2/1/2024 to report their MCLE to the State Bar. Speaker: Felicia A. Smith, MLIS., is the inaugural Racial Justice and Social Equity Librarian, at Stanford Libraries. As an African American Librarian, Felicia is charged with the awesome responsibility of being a keeper of the light and a protector of our shared memories. Felicia was the visionary for the libraries’ popular exhibit titled, Say Their Names – No More Names, which has been translated into Chinese, Spanish and German. To access the translations, simply click the drop-down menu under “English” in the header. Felicia hopes that this allows people in more communities to read these stories. This is Stanford Libraries’ most translated exhibit. 

Event Info: She will discuss some of the efforts nationwide to whitewash (literally) American history by censoring the teaching of events in Black history as well as other subjects such as the movement for Diversity and Equity in all aspects of our public life.

In September, 2022, Governor Newsom signed AB 1663, which reforms California’s probate conservatorship system to enable disabled people needing support to pursue supported decision-making as a less restrictive alternative to conservatorship. The bill also makes it easier to end a conservatorship. What does this mean for conservatorship attorneys? Ms. Cookman will discuss this and supported decision-making in general.

Our presenters will be Ellen Cookman who is principal of Cookman Law in Palo Alto, California. She is passionate about helping families of all shapes and sizes plan for the future and utilize available resources. Ellen is a Certified Specialist in Estate Planning, Trust & Probate Law from the California State Bar Board of Legal Specialization. This event will feature District Attorney Steve Wagstaffe who will speak about the efforts and to what extent the Office of the District Attorney has been able to put in place new practices and policies, in response to recent events and resulting legislation pertaining to issues of racial and social justice, and to assure the community that facially neutral penal laws are a reality. He will report to the legal community and community at large how those laws are not employed in a manner that in effect discriminate against members of minority community. The office of the District Attorney has conducted trainings to avoid any such discriminatory practices and he will discuss those, as well as other steps that office has taken with regard ensuring cultural and racial fairness in the courtroom. Participants hopefully will be able to ask Mr. Wagstaffe about such matters particularly as they affect public perception of the criminal justice system in this County.

Description: The seminar will provide an overview of issues that arise when a litigant dies or becomes incapacitated in the midst of a family law action. The speaker will describe the nuances between the Family Code and Probate Code and help practitioners understand which law applies following a death.
