The Diversity, Equity, & Inclusion Committee is proud to present its award-winning 15th Annual Speakers Series. Our speaker this year will be Justice Kelli M. Evans an Associate of the California Supreme Court on Thursday, October 26, 2023, from 5:00pm to 7:30pm.

Speaker: Justice Kelli M. Evans serves as an Associate Justice of the California Supreme Court. Before joining the Supreme Court, Justice Evans served as a Judge in the Alameda County Superior Court, presiding over both criminal and civil matters.

Prior to her appointment to the Alameda County bench, Justice Evans served as Chief Deputy Legal Affairs Secretary in the Office of Governor Newsom, where she advised the Governor and executive agencies on a variety of legal, policy, and legislative issues.

Justice Evans previously served as Special Assistant to the Attorney General at the California Department of Justice with a focus in criminal justice, public safety, and civil rights law and policy.

Justice Evans has had a career of public service. Before joining the California Department of Justice, she served as Senior Director for the Administration of Justice at the California State Bar. Prior to joining the State Bar, she was Associate Director of the ACLU of Northern California and served as a Senior Trial Attorney in the Civil Rights Division of the U.S. Department of Justice, and as an Assistant Public Defender at the Sacramento County Public Defender’s Office. Justice Evans also has served as a member of federal court-appointed monitoring teams for the Oakland and Cleveland Police Departments.

Justice Evans has sat on the governing boards of a number of non-profit organizations and currently serves on the California Commission on Access to Justice. She has received numerous awards and recognition including the King Hall Distinguished Alumna Award, the Stanford Trailblazer Award, Judge of the Year Award, Attorney General’s Award for Exceptional Service, State Bar President’s Award, and a Medal of Achievement from the Washington Metropolitan Police Department.    

Justice Evans received her undergraduate degree from Stanford University and her law degree from the University of California at Davis, where she was the recipient of the Martin Luther King, Jr. Award for Public Service.

The Scholarship is given to an incoming/current law student, or recent graduate who has not passed the bar exam to encourage and support their commitment to the legal profession and diversity in our community.

WhatLegal Malpractice Post-COVID Primer for Lawyers

Our speaker, Jason E. Fellner, a Certified Specialist in Legal Malpractice Law and founding partner of Millstein Fellner, LLP, will discuss the ways in which lawyers and law firms can protect themselves against legal malpractice claims.  The program will begin with an overview of legal malpractice claims, how they differ from breach of contract, breach of fiduciary duty, and fraud claims routinely raised against lawyers, and the best ways lawyers and law firms can institute procedures that not only comply with the California Rules of Professional Conduct, but also exceed the professional standard of care that should eliminate the viability of any potential claim.  The program will end with a Q&A session.

Who: Jason Fellner is a founding partner of Millstein Fellner, LLP. Mr. Fellner is a top-rated trial lawyer who represents individual and corporate clients throughout California with a focus on complex civil litigation. Mr. Fellner has successfully represented clients in all phases of dispute resolution from pre-litigation mediation and arbitration all the way through trial. He also serves as general counsel to companies and law firms. A hallmark of his practice, Mr. Fellner works collaboratively with his clients in providing them with recommendations on how best to address the legal, financial, and the emotional aspects of each case. He is recognized by the California State Bar as a Certified Specialist in Legal Malpractice Law and is a Board Certified Diplomate of the American Board of Professional Liability Attorneys. He speaks regularly and often to lawyers on legal ethics and also serves as an expert witness on legal malpractice and ethics.

Our speaker, IRS Supervisory Estate Tax Attorney Kyle Martin, will address current issues in examinations of Estate and Gift Tax Returns and procedures helpful to all tax professionals. Topics include : Adequate Disclosure on Gift Tax Returns, Recent Revenue Procedure 2022-32 for Portability of the DSUE, Proposed Regulations for IRC § 2053, Closing Letters for Estate Tax Returns, and the Importance of a Good Appraisal.

Speaker: Kyle C. Martin is a Supervisory Estate Tax Attorney with the Internal Revenue Service in Oakland, California. He has been with the Service since 1989 and in his current position since March of 2006. Kyle is a graduate of the University of Kansas with a Bachelor of Arts degree in Psychology. In 1993, Kyle received his Doctor of Jurisprudence degree from San Francisco Law School. He has been a member of the California State Bar since December of 1993. As the Supervisory Attorney, Kyle manages: one Estate Tax Attorney, six Estate Tax Legal Specialists, one Paralegal Specialist and one Legal Assistant. Before obtaining his current position, Kyle was a field Estate Tax Attorney in San Francisco and Oakland from 1994-2006.

Cost: Cost is $50 per person for members of the SMCBA Estate Planning Section for the luncheon and $65 for non-members for the luncheon. Cost includes lunch and 1.0 hour of General Law MCLE.

Our speaker, Brett Greving will provide insight on the current state of PAGA in California. He will discuss the impact of the California Supreme Court’s Decision in Adolph v.  Uber Technologies, Inc.  and how this decision impacts the PAGA landscape moving forward.  

Who: Brett has more than 10 years of employment law experience, providing practical legal solutions for businesses in a heavily regulated employment environment and provides stout defense to employment lawsuits. Brett represents employers of all sizes in state and federal court litigation, handling class actions and individual matters with a particular focus on wage and hour class actions, Private Attorney General Act and Fair Labor Standards Act Collective actions, and trade secret lawsuits. He has experience handling hearings and proceedings before administrative agencies, including the California Labor Commissioner, FINRA, the EEOC, and the DFEH.

Estate Planning and Probate Section- Non-Pro Rata Distributions in Trust Administrations: Creating Equalized Divisions- September 21

Presenters will discuss the issues and concerns involved in a non-pro rata distribution of trust assets, the trustee’s authority under Probate Code §16246 and the powers set forth in a trust instrument.  The discussion will touch on changes in real property valuation under the newly adopted partition laws, Property 19 property tax reassessments, and complications with an illiquid trust.

The San Mateo County Barristers Section is an organization of new lawyers committed to professional growth, community service, and serving as an advocate for its members.

The Barristers hosts an Annual Judges’ Luncheon each calendar year, this year it will be held at the San Mateo County Historical Courthouse on September 14, 2023, from 12:00-1:30 p.m. The Luncheon will honor our esteemed San Mateo County judiciary and introduce the new members of the bar to the bench.

Throughout the year, the Barristers perform philanthropic services for the community and provide a support network for new attorneys. Events include the “Meet and Greet” event which orients new attorneys in San Mateo County by providing a panel discussion with judges and other leaders of the local bar, and the brown-bag lunch series with judges to help new lawyers learn to advocate for their clients more effectively. The Barristers engage in community service by holding an annual BBQ and holiday party for the residents of local family shelters and volunteering at the Second Harvest Food Bank.

To make all of these events happen each year, the Barristers depend on the generosity of our community contribution through various fundraising events, including through sponsorship of the Annual Judges’ Luncheon. In order to make all of the Barristers events happen each year, the Barristers ask for sponsorship of the Judges’ Luncheon.

We will have a presentation by various speakers, including our keynote speaker, the Hon. Justice Maria P. Rivera, as well as a roundtable for bench officers.
