Join SMCBA for our Annual Meeting, Installation of Officers and Barristers, and Award Presentation on Thursday, March 2, 2023. 

The James M. Dennis Memorial Award, the William Nagle, Jr. Memorial Award, and the Dennis L. Woodman Memorial Award will be presented at this event. 

Cost:  $80 per person. Judges attend for free but must register.

James Madison describes Supreme Court and other Appellate Court decisions on arbitration that came down in 2022 which everyone who practices in this area should know about.

Speaker: James R. Madison, of Madison Mediation in Menlo Park, California has more than 40 years’ experience as an arbitrator and more than 20 years’ experience as a mediator in both domestic and transnational cases, covering design and/or construction or employment disputes, technology and biotech disputes to real property, franchising, intellectual property, mortgage banking, advertising, international trading, personal property leasing, and vegetable seed breeding.  Mr. Madison is an adjunct professor at USF in Arbitration, past president of the California Dispute Resolution Council, a member of numerous bar and legal organizations focusing on arbitration (including the American Bar Association Dispute Resolution Section, The Mediation Society, and the College of Commercial Arbitration), and a graduate of Stanford University for both his undergraduate and law degrees.

Family Law Section- Status Conference Volunteer Training- March 1

Please join us on Wednesday, March 1, 2023, for a status conference volunteer training offered by The Honorable Rosendo Padilla, Jr. and Kevin Cunningham. The training will take place via Zoom.

This training is designed to teach both new and experienced attorneys the ins and outs of serving as a status conference volunteer attorney. Among other things, the training will cover:

• Role of the status conference volunteer;
• What is expected of the volunteer status conference attorney;
• Tips on getting pro per litigants to Judgment; and,
• Instructions on when and how to refer pro per litigants to other ADR options.

The Court would greatly appreciate your participation as a volunteer attorney. Calendars are held on Monday and Thursday afternoons, as well as Tuesday mornings.

The Funky Credit Day Program is held each year for members of the State Bar of California who are actively practicing law. It is where you get those “funky,” hard to find credits. Our 2023 program will feature various presenters including attorneys and judges from San Mateo County Superior Court. Once again, this year in consideration of the ongoing COVID-19 pandemic, we will deliver our annual event virtually.

Estate Planning and Probate Section- Irrevocable Life Insurance Trusts (ILIT)- February 9

This presentation will provide an overview of the Irrevocable Life Insurance Trust (ILIT) formation and funding process from start to finish. The presenters will begin by discussing what an ILIT is, as well as reasons to propose the estate planning tool of an ILIT to your clients. After discussing the basics of ILITs, the presenters will discuss considerations that you, as the planner, should reflect upon while drafting the ILIT. This will include tailoring the ILIT to your clients’ specific wants and needs. Lastly, the presenters will provide guidance in preparing the corresponding gift tax return (709).

Estate Planning & Probate Section- Subtrust Allocation for Litigation Attorneys- November 17

Description: During this presentation, Judge Glen Reiser (Ret.) will discuss various critical aspects of subtrust funding as part of the trust administration process.  Often, upon a first death of a spouse and, at times, upon the death of the second spouse to die or a single person, the subject trust includes requirements and guidance for administering the trust regarding the allocation of assets to various subtrusts for the benefit of one or more beneficiaries.  As we are seeing it more and more in the courts and mediation, subtrust allocation decisions by a trustee can turn into having to defend a claim against such trustee for failure to, among other things, collect assets and obtain date of death values, property manage assets, and fairly allocate assets among subtrusts in accordance with the terms of the trust.  The presentation will cover important concepts such as a trustee’s administrative duties, marital deductions, pro-rata allocation of assets, community property and separate property characterizations, gift and estate taxes, and portability, all in light of trust litigation. Judge Glen Reiser (Ret.) will teach these concepts by reviewing trust provisions and discussing hypotheticals and relevant recent case law. Litigators, trust administration lawyers, and estate planning lawyers will all benefit from attending this presentation to better allocate assets to subtrusts, lower the likelihood of litigation, and successfully complete the trust administration process

The EP Section is pleased to announce its initial post-Covid live event. To celebrate the holiday season and end of the year, we are returning to the San Mateo Elks Lodge for our annual Judge’s luncheon.

We are pleased to have the Honorable Susan L. Greenberg, Probate Judge for the San Mateo County Superior Court, join us at our annual holiday party. Judge Greenberg will speak to our section regarding this past year on the Probate Bench and what to expect in 2023. This is a program you will not want to miss. Please arrive early as we expect this event to be well attended.

Lunch will be included for the in-person attendees.

For those members who wish to register for an online webinar rather than in-person luncheon, a live stream of the presentation will be available.
