Description: The goal of any mediation is to resolve the case.  But how do you maximize the benefits of a mediation without giving away too much to the other side?  With extensive experience as a litigator and mediator, our speaker understands these concerns – and how to handle them.  Whether it’s about your own client, great evidence you don’t want to reveal, or even your ultimate goals at mediation, you will get the inside information on the “who”, “what”, “when”, and “why” of information sharing to help you get the most out of your mediation – and your mediator.

Who: Our speaker, David Sarnoff’s, extensive experience as a litigator led him to start mediating, and in 2018, David received formal mediation training at Pepperdine University’s Straus Institute. He now combines this training with his experience as a litigator and small business owner to help litigants realize the benefits of compromise and resolution in order to let go of the past and move on with their lives. He greatly values his work as a mediator and finds it deeply rewarding to help parties resolve disputes and provide them the freedom to look forward to better days.  David mediates throughout California in all areas in which he has significant experience, including all aspects of Employment Law, Personal Injury, Real Estate, and General Business Litigation. He is also a Mandatory Settlement Conference Officer for the San Francisco Superior Court and Los Angeles Superior Court through Resolve Law LA. Please join the Family Law Section on Wednesday, February 23, 2022, for a presentation by Vocational Experts Soma McCandless and Marlis Bruns on recognizing BIAS in the vocational evaluation process. They will provide recommendations on how to help ensure an impartial evaluation for your client.  An objective evaluation can be used to help settle support issues in your dissolution cases.

Both Marlis and Soma evaluate individuals for the purpose of assessing future employability and wage earning capacity in conformity with California Family Code, Section 4320. They are knowledgeable of local area training and education programs, current employment conditions, job markets and compensation in the Bay Area.

Marlis Bruns has been a Vocational Evaluator Since 2001.  She has qualified and testified as a court expert in Contra Costa, Alameda, San Mateo, San Francisco, Santa Clara, San Joaquin, Solano and Sacramento Counties. She has also performed out-of-state assessments and qualified to testify in Colorado and Texas. Marlis has a Master’s of Arts degree in Counseling Psychology from the Golden Gate University and a Bachelor’s of Arts degree from California State University, Chico. She belongs to the following professional associations: Bay Area Vocational Experts, American Board of Vocational Experts (Diplomat), National Career Development Association, California Career Development Association, Alameda County Bar Association, Contra Costa County Bar Association.

Soma McCandless has been a Vocational Evaluator since 2018.  She draws from her experience of over 14 years in the fields of technology consulting, education and the nonprofit sector.  She has qualified and testified as a vocational expert in Santa Clara, San Mateo and Contra Costa Counties.  She obtained a  Bachelor’s of Science degree in Mechanical Engineering from Massachusetts Institute of Technology (MIT).  She also has a Master’s of Arts degree in Education with focus on Multicultural Counseling and a Mental Health Recovery and Trauma Informed Care Certificate from San Diego State University.  She belongs to the following professional associations: Bay Area Vocational Experts, American Board of Vocational Experts, and the National Career Development Association.  

You will receive 1 hour of General Law and Recognition and Elimination of Bias MCLE credit for attending this event. MCLE certificates will be made available in the week following the event.

We will discuss the detection of substance abuse that may impair an attorney’s ability to perform legal services with competence.  We will discuss the differences between use, abuse and addiction of mood-altering chemicals and behaviors and how that can affect daily life in the legal profession.

Our speaker, Daniel Glatt MD MPH is a Board Certified physician in Internal Medicine and Addiction Medicine.  He currently is in private practice in Burlingame.  Dr. Glatt completed his Internal Medicine training in the US Navy and served 7 years on active duty.  He received his Master’s in Public Health from the Harvard School of Public Health.  He completed a fellowship in Addiction Medicine at the San Francisco Veteran’s Administration Medical Center.  In addition to his Internal Medicine and Addiction Medicine practice, he does medication management for patients with chronic pain.

The Diversity Committee is proud to present its award-winning 13th Annual Speaker Series.  This year, our annual Speaker Series event will be conducted live at the “The Old Courthouse,” on Thursday, October 21, 2021, from 5:00pm to 7:00pm. You are invited to join us in person or virtually! 

Our Guest Speakers this year included, Presiding Judge Leland Davis, III, Justice Teri L. Jackson, and Judge Erica R. Yew.

Presiding Judge Leland Davis, III received a B.A. Degree in Economics in 1980 from Stanford University and his J.D. Degree from Boalt Hall School of Law in 1983. Judge Davis got appointed to the San Mateo Superior Court bench by Governor Arnold Schwarzenegger in 2010, filling a vacancy created by the retirement of the Honorable Carol. L. Mittlesteadt. During his time on the bench, Judge Davis served as a Trial Judge, then as a Criminal Presiding Judge, and Civil Grand Jury Judge. From 2016 until 2018, Judge Davis served on the Appellate Panel and served as a Criminal Supervising Judge from 2017 to 2018. In 2019, he became the Assistant Presiding Judge and began his first term of Presiding Judge this year.

Justice Teri L. Jackson received her B.A. in 1977 from the University of California, Santa Cruz, where she majored in politics. She earned her J.D. in 1980 from Georgetown University Law Center in Washington, D.C. Justice Jackson was appointed to the California Court of Appeal, First Appellate District, in November 2019 by Governor Gavin Newsom. The Commission on Judicial Appointments confirmed her appointment in January 2020. She is the first female African-American justice on the state’s First District Court of Appeal. Justice Jackson serves as an associate justice in Division Three. As of July 9th, the Governor nominated Justice Jackson for the position as the Presiding Justice, Div. 5, 1DCA.

Judge Erica R. Yew was appointed to the Santa Clara County Superior Court in 2001 as that court’s first female Asian American Pacific Islander judge.  She has served on the California Judicial Council, the Commission on Judicial Performance (for which she served as Chair) and the NAPABA Judicial Council (for which she served as president) among other entities.  Currently, she serves on the Supreme Court Committee on Judicial Ethics Opinions and the California Access to Justice Commission.  She is newly appointed to the board of the National Center of State Courts, and she will join the California Judges Association Board later this year.

In 2019, the Court of Appeal published an opinion regarding the probate court’s sua sponte removal of co-trustees.  Trolan v. Trolan, along with prior case law, provides important insight into the issue of trustee removal. Hoge Fenton attorneys Denise Chambliss and Ariel Siner will provide analysis and insight into the issue of trustee removal with recommendations for Dos and Don’ts in either petitioning to have a trustee removed or defending a trustee removal action.

Prison profiteers have made fortunes on mass incarceration, and, in doing so, have become an important factor driving the incarceration of adults and children in the U.S. In this presentation, Sivani Babu brings context to the conversation about the prison-industrial complex by drawing on existing research as well as her experiences as an assistant federal public defender in South Texas. From for-profit facilities to telecom and healthcare services, she sheds light on the impact of decades of privatization in our prison system and what we can do to effect change.

Sivani Babu is an award-winning conservation and exploration journalist and the co-founder and co-CEO of Hidden Compass — a women-led, exploration-focused media company. She is also a former assistant federal public defender for the Southern District of Texas. Working in one of the busiest districts in the nation, she represented defendants charged with a wide variety of federal felonies, from immigration to financial fraud and drug trafficking offenses. Part of that representation often included working to secure basic healthcare for clients held in for-profit facilities.

The San Mateo County Bar Association’s Race & Social Justice Committee and the Private Defender Program invite you to attend The Pruno Project: Exonerated Prisoners webinar. The Pruno Fund is a non-profit dedicated to helping exonerees transition from prison to life on the outside. The thousands of men and women who have been exonerated of their wrongful convictions have a lot to teach us about perseverance, patience, and hope. Join us and listen to two amazing men, Zavion Johnson and Obie Anthony, who will share their unbelievable life experiences!

Obie Anthony was sentenced to life without parole for a murder he did not commit when he was 19 years old. California incarcerated him for 17 years. Upon exoneration, Obie dedicated himself to supporting other exonerees to meet their basic needs after release. Obie was instrumental in the passage of California Assembly Bill No. 672 (nicknamed and cited as “Obie’s Law”). The bill requires the California Department of Corrections and Rehabilitation to assist exonerees with transitional services, including housing assistance, job training, and mental health services. In 2016, Obie founded Exonerated Nation, and is committed to transforming the experiences of exonerees after release and building a community that can provide safety, stability, and healing to wrongfully convicted Californians.

Zavion Johnson is an exoneree who served half his life falsely accused after being imprisoned at the age of 19. Losing his trial, Zavion was convicted of the false charges, sentenced to double life and sent off to serve his sentence at the most deadly maximum security level IV facilities. Being an innocent man, Zavion fought tirelessly to regain his freedom by filing numerous court documents and wrote to many organizations he felt could help him gain his freedom. Since his exoneration in late 2017, Zavion has spent time adjusting to life outside and educating California state legislators, attorneys, college students, and law school student to ensure that no one else suffers the injustice he endured. Zavion sits on the advisory board of Exonerated Nation, a nonprofit organization which helps exonerees like him with after care and re-entry services.

This event qualifies for 1 hour of Elimination of Bias MCLE credit.
